  • Syncopate Lab | Brainbox Institute

    Increasingly, law and legal activities are implemented and performed through digital systems. This presents both risk and opportunity. Brainbox is working with long-time partner, Verb, to conduct public-facing experiments showing how technology itself can be used for regulatory purposes. We are doing this through Syncopate Lab. < Back Syncopate Lab Current Project 2019 - current Together with Verb , Brainbox has founded Syncopate Lab (also known as the Digital Legal Systems Lab). Syncopate reflects our commitment to demonstrating the benefits of better digital legal systems through applied examples, working directly with real clients and stakeholders on real systems. Syncopate was founded based on our commitment to the rule of law, to public service and the public interest, and making sure digital systems and legal systems better reflect one another. Ineffective and inefficient systems not only hurt to use, but can cause real harm too, to the people who use them, and the people who are affected by the outcomes they produce.   • Is the New Zealand legal system ready for deepfakes? | Brainbox Institute

    In 2018, Brainbox received support from the New Zealand Law Foundation to publish a report called 'Perception Inception', which looked at the legal implications of emerging synthetic media technologies, including "deepfakes". < Back Is the New Zealand legal system ready for deepfakes? Past Project May 2019 In 2018, the sky was falling. New technologies let more people than ever before make it look or sound like something had happened when it never had. We applied to the New Zealand Law Foundation to investigate these technologies. What could they do? How good were they? What harms might they cause? We assessed the New Zealand legal system to consider whether we were ready. We concluded by urging caution against regulating for deepfakes due to risks to freedom of expression. We found a range of legal mechanisms that could be used to remedy harms, but recommended that the law on non-consensual intimate visual recordings be clarified. "The chapter outlines the initial difficulties of regulating synthetic media technologies, while introducing the reader to the fundamental problems that synthetic media poses to international security. Synthetic media also includes a range of ordinary communications technologies that are designed and utilized for everyday civilian purposes, including augmented reality, virtual reality, computational photography, photo editing, and voice synthesis technologies. It is unstable and unreliable for regulatory purposes, in part because it infers that deepfakes are delineable and distinct from other synthetic media in the technologies and resources used to create them." While the Justice Committee recently declined to incorporate clarifying amendments around synthetic “pornography”, MP Louisa Wall introduced a supplementary order paper proposing an amendment that would resolve the legal ambiguity we identified.   • Content regulation and disinformation in New Zealand | Brainbox Institute

    New Zealand is among the countries around the world looking to regulate disinformation and other user-generated content. Brainbox is conducting legal research with funding from the Borrin Foundation and InternetNZ to investigate how disinformation can be approached as a policy problem without undermining human rights principles. < Back Content regulation and disinformation in New Zealand Past Project 2022-2024 The Borrin Foundation and InternetNZ have funded Brainbox to investigate legal frameworks for regulating disinformation. This project will take place from late 2022 through to the end of 2023. Currently, a number of jurisdictions around the world - including New Zealand - view disinformation as a policy problem and are considering how to regulate it. While there is considerable pressure and urgency for governments to introduce legislation, the issue of disinformation and the harms it causes are still poorly understood. Consequently, state interventions against disinformation risk negatively impacting human rights. Brainbox seeks to provide concrete answers to legal questions, clarity on technical considerations, and a usable framework for balancing the rights, responsibilities, and risks inherent in this area. This will be of immediate benefit to scholars, civil society, and government, and of indirect benefit to New Zealand society as a whole by ensuring that government and civil society responses to disinformation are both better informed and grounded in a strong legal and human rights framework. It will also play a crucial role in connecting civil society networks in New Zealand to broader international efforts.   • Tribal digital identity project with Āhau | Brainbox Institute

    In partnership with Verb and the Digital Legal Systems Lab (now known as Syncopate Lab), Brainbox carried out legal research and design with Āhau, a platform developing a decentralised digital identity services for iwi and hapū to register their tribal affiliations. < Back Tribal digital identity project with Āhau Past Project 2022-2023 In partnership with Verb , Brainbox carried out legal research and design for Āhau , a platform developing a decentralised digital identity service for iwi and hapū. This project began in November 2022 and continued through to October 2023. It was funded by the Cardano network's Project Catalyst . Traditionally, digital identity services in Aotearoa New Zealand have not served Māori communities well - for many Māori, their data is housed in centralised digital databases that do not recognise concepts like mana or tino rangatiratanga. After extensive community consultation, Āhau began developing a decentralised digital identity service that specifically caters to the needs of iwi and hapū. In mid-2022, Āhau approached Brainbox and Verb to advise on the existing legislation and rules when it comes to building a new digital identity service, as well as suggest any adjustments that could be made to the rules or their intended products. This project was particularly timely, given that the Department for Internal Affairs were in the process of making changes to their digital identity system. Brainbox and Verb therefore also helped Āhau engage with DIA’s developing understanding and regulation of digital identity, in a way that avoided recolonisation and ensured the digital identity needs of Māori were being met. This project sat under the Digital Legal Systems Lab (now Syncopate Lab), a public interest initiative orientated toward building trust in digital legal systems and digital regulatory design through open case studies and applied examples.   • Internet Infrastructure Resilience | Brainbox Institute

    A nationwide initiative to strengthen New Zealand's Internet infrastructure against climate change and extreme weather events. The Internet Infrastructure Climate Resilience Coalition brings together industry, government, and community partners to build a more resilient digital future for Aotearoa. Internet infrastructure in a changing climate Climate change and extreme weather events are increasingly testing the resilience of New Zealand's Internet infrastructure, when Internet access is a critical part of everyday lives and a lifeline for communities during emergencies. In early 2023, many communities across Aotearoa experienced firsthand how weather-related disruptions to Internet connectivity impact their lives and compound the challenges of disaster response and recovery. Drawing from these experiences and supported by the Internet Society Foundation, this collaborative research initiative will work to strengthen the ability of New Zealand communities to face climate impacts and extreme weather events by improving the resilience of our national Internet infrastructure. At the heart of this project is the creation of an Internet Infrastructure Climate Resilience Coalition, an action-focused initiative bringing together diverse stakeholders from industry, government, research, and communities to share insights, learn collectively, and develop practical solutions. By fostering collaboration across sectors, we aim to better understand the vulnerabilities and the complex systems that impact Internet infrastructure, including the links with communities and community wellbeing. The research will support collaborative work to identify actions which can be taken to enhance the resilience of New Zealand's Internet infrastructure, and through this the resilience of our communities. The coalition's work begins in 2025 and extends into 2026, complemented by comprehensive desk research. This project represents a collaboration between Dr Ellen Strickland, the Brainbox Institute and the New Zealand Telecommunications Forum, building on insights from the Critical Infrastructure Lab at the University of Amsterdam.
